The nullity of treaties: the case of the naval base in Guantanamo

Abstract

The aero-naval base hold by the United States in Cuba is located in the southern part of Guantanamo Bay.  It has been an object of study for many different politicians, jurists and historians, all of whom support often divergent criteria and/or points of view regarding the legality of the American Naval Base in Cuban territory. However, the present article won’t focus on this specific aspect, but will rather analyze and evaluate, under the light of Public International Law, the possibilities that may or may not exist concerning the nullity of the present treaty of said military enclave.
