Legal tools to combat Islamophobia in the European Union

The perception of being discriminated against, being a victim of manifestations of hatred and violence generates in the human being a sense of alienation and insecurity. Prejudice, discrimination and intolerance towards Islam and Muslims has increased since the last years of the twentieth century. International organizations have followed up on this phenomenon, called Islamophobia. But the contradictions generated by this term, the prejudices of society and the negative attitudes towards Islam have constituted an obstacle to its correct eradication. This article aims to make an analysis of the mechanisms of European Union law to confront Islamophobia, paying special interest in the positions taken regarding this phenomenon in the two highest legal instances in Europe: the Court of Justice of the European Union and the European Court of Human Rights
